Use the service with consent and reasonable care

1. Agreement

These Terms govern the service operated by Probably Human. By creating, completing, reviewing, or sharing a Human Check, you agree to these Terms and the Privacy Notice.

2. Who may use the service

You must be at least 18 years old and legally able to agree to these Terms. You may record only yourself and other adults who knowingly agree to appear.

3. Recording and final confirmation

A recipient may record up to seven short attempts. Each completed attempt is sealed into the private session. If the recipient sends final confirmation, the requester receives the complete attempt history, including attempts whose automated signals were incomplete. The recording screen explains this before camera access is requested. Acceptance applies to all attempts within that Human Check in the current browser session; the service does not require the same disclosure before every attempt.

4. What the service does

The service provides limited evidence that someone produced a fresh response for a particular request. It does not verify legal identity, age, background, ownership, employment, authority, honesty, intentions, or safety. Automated checks can miss real actions and can be manipulated.

5. Your responsibilities

• Use the service only for a lawful and legitimate purpose
• Give accurate names or usernames that identify the conversation without impersonating another person
• Protect challenge and review links as private access credentials
• Use other verification and safety measures when money, travel, employment, housing, or an in-person meeting is involved
• Obtain permission before publishing or forwarding another person’s recording
• Review the actual video and other available evidence instead of treating an automated status as a final decision

6. Prohibited use

• Secret recording, coercion, harassment, stalking, extortion, blackmail, or surveillance
• Sexual, exploitative, or abusive content, especially content involving minors
• Impersonation, fraud, trafficking, money laundering, or evasion of law enforcement
• Malware, automated abuse, denial-of-service activity, scraping private links, or bypassing access controls
• Using a Human Check as the sole basis for employment, housing, credit, insurance, education, immigration, policing, or another high-impact decision
• Claiming that the service provides government identity verification or a guarantee of safety
• Removing, obscuring, or altering a watermark in order to misrepresent where, when, or how a recording was created
• Using the service to trick someone into traveling, sending money, disclosing credentials, or entering an unsafe situation

7. Your recordings

You represent that you have the right to submit the content and that the recording does not unlawfully include another person. You retain any rights you have in content you submit. You grant Probably Human a limited, nonexclusive license to host, process, analyze, transmit, display to the authorized reviewer, secure, and delete that content only as needed to operate and protect the service.

8. Private links

Anyone who obtains a valid review link may be able to view the submitted attempts until they expire. Do not post private links publicly. We cannot prevent access caused by a link that you publish, forward, or store insecurely.

9. Moderation and suspension

We may block a request, remove content, restrict access, preserve evidence, or suspend the service when reasonably necessary to investigate abuse, protect users, comply with law, or maintain service integrity.

10. Assumption of risk

You are responsible for decisions involving online contacts. A person can complete a live challenge and still lie, impersonate someone else, act under coercion, or intend harm. Do not rely on a Human Check as your only safety measure before meeting, traveling, sending money, sharing intimate material, granting account access, or providing identity documents.

11. Watermarks and integrity information

The service may add visible watermarks, challenge codes, timestamps, and technical metadata to recordings and preview frames. These features provide context but are not tamper-proof. You may not remove or modify them for fraud, impersonation, or misrepresentation.

12. Third-party services

The service may rely on hosting, database, storage, security, analytics, browser, and network providers. Their availability and terms may affect the service. Links shared through messaging or social platforms are also subject to those platforms’ rules.

13. Service changes

We may modify, limit, pause, or discontinue features. We may update these Terms by posting a revised effective date. Material changes will apply prospectively unless law requires otherwise.

14. Disclaimer

The service is provided “as is” and “as available.” To the fullest extent permitted by law, Probably Human disclaims warranties of accuracy, reliability, fitness for a particular purpose, noninfringement, and uninterrupted or error-free operation.

15. Limitation of liability

To the fullest extent permitted by law, Probably Human will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for losses arising from reliance on a Human Check, unauthorized link access, scams, meetings, travel, payments, or third-party conduct. Mandatory consumer rights remain unaffected.

16. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold Probably Human and its service providers harmless from claims, losses, liabilities, and reasonable costs arising from your unlawful use of the service, your content, your violation of another person’s rights, or your breach of these Terms. This provision does not apply where prohibited by mandatory consumer law.

17. Governing law

These Terms are governed by the laws of Georgia, without limiting any mandatory protections that apply where you live.

18. Severability

If any part of these Terms is unenforceable, the remaining provisions will continue to apply. A failure to enforce a provision is not a waiver of that provision.
